<strong>YES<\/strong>.<\/p>\n\n\n\n<p>If you\u2019d like to <strong>provide your services in Germany<\/strong>, you\u2019ll need to register as a freelancer to <strong>make sure you meet your legal and tax obligations<\/strong>.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"how\">How do I become a freelancer in Germany?<\/h2>\n\n\n\n<p>Besides its great <strong>healthcare system<\/strong>, Germany is also known for its <strong>bureaucracy.<\/strong> And so, <strong>freelancing in Germany<\/strong> might seem a bit challenging at first.<\/p>\n\n\n\n<p>You\u2019ll have things like taxes, health insurance, required documentation, etc. to consider but before you worry about all of this, you\u2019ll need to understand the <strong>options you have to start your own business<\/strong>.<\/p>\n\n\n\n<p>There are<strong> different concepts <\/strong>around the <strong>term freelancing in Germany<\/strong>: <strong><em>Freiberufler, freier Mitarbeiter, Freelancer, <\/em><\/strong><em>or<\/em><strong><em> Gewerbe<\/em><\/strong>.<\/p>\n\n\n\n<p>It\u2019s important to understand these to know which <strong>legal form you\u2019ll need<\/strong>. So let\u2019s take a look at the options.<\/p>\n\n\n\n<p>Professionals who want<strong> to go freelancing in Germany<\/strong> can choose between two forms of sole proprietorship: <strong>non-commercial and commercial<\/strong>. In both cases, the founder must be a <strong>natural person<\/strong>.&nbsp;<\/p>\n\n\n\n<h4 class=\"wp-block-heading\">#1 Commercial: <em>Gewerbliches Einzelunternehmen<\/em><\/h4>\n\n\n\n<p>If you work as a <strong>tradesperson<\/strong> and run a <strong>commercial business<\/strong> that sells products, your work is classified under the trade self-employment <em>\u2018Gewerbe\u2019<\/em>. To begin, you must first<strong> register with the German trade register <\/strong>or <em>\u2018Handelsregister\u2019 <\/em>and then contact the trade office to apply for a trade licence.&nbsp;<\/p>\n\n\n\n<p>You will then need to <strong>pay trade tax<\/strong> <em>\u2018Gewerbesteuer\u2018<\/em>. The trade tax varies depending on the city you\u2019re in and is calculated by multiplying <strong>3.5% <\/strong>of your profits with the local tax factor \u2018<em>Hebesatz<\/em>\u2019.<\/p>\n\n\n\n<p>You can register as a \u201cKleingewerbetreibender\u201d to not pay the trade tax (\u201cGewerbesteuer\u201d)<\/p>\n\n\n\n<h4 class=\"wp-block-heading\">#2 Non-commercial:<em> Freier Mitarbeiter<\/em> (Freelancer)&nbsp;<\/h4>\n\n\n\n<p>A <strong>freelancer<\/strong> or <em>\u2018Freier Mitarbeiter\u2019 <\/em>is a person who is hired by companies for <strong>short-term projects or tasks<\/strong>. These professionals are not direct employees of the company but work on a <strong>contract basis<\/strong> (<em>Werkvertrag<\/em>).<\/p>\n\n\n\n<h5 class=\"wp-block-heading\">Is a Freiberufler a Freelancer?<\/h5>\n\n\n\n<p>The term \u201c<strong>Freiberufler<\/strong>\u201d identifies professionals as members of a certain professional occupation (<a href=\"https:\/\/www.gesetze-im-internet.de\/estg\/__18.html\" target=\"_blank\" rel=\"noreferrer noopener\" aria-label=\" (opens in a new tab)\">\u00a7 18 para. 1 EStG<\/a>), but it\u2019s<strong> not a legal form<\/strong>.&nbsp;<\/p>\n\n\n\n<p>\u201cFreie Berufe\u201d includes professionals with <strong>medical, pedagogical, consulting or technical occupations<\/strong>. Technical professions such as software developers, or IT consultants are becoming increasingly popular.<\/p>\n\n\n\n<p class=\"has-background\" style=\"background-color:#f3f3f3\">\ud83d\udca1 If you are unsure about your case, we recommend you check your case at the tax office (\u201c<em>Finanzamt&#8221;<\/em>) or the trade offices (\u201c<em>Gewerbeamt&#8221;<\/em>). You could also consult a lawyer or tax advisor before registration.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\" id=\"reg\">#1 Freelancing in Germany: Registration (Freiberufler anmeldung)<\/h3>\n\n\n\n<p>The process of <strong>registering and becoming a freelancer in Germany<\/strong> is going to be easier or more complicated depending on your passport (aka. nationality).<\/p>\n\n\n\n<p>If you are in <strong>Germany (and a EU, EAA, or Swiss citizen<\/strong>)<strong> <\/strong>the process will be easier for you as you can work without a visa in the German labour market.<\/p>\n\n\n\n<p>To <strong>register as a freelancer<\/strong>, you will need to submit a form to the German Tax office (<em>\u201cFinanzamt\u201d<\/em>) called<strong> <em>Fragebogen zur steuerliche Erfassung<\/em><\/strong>.<\/p>\n\n\n\n<p>You can do this online via ELSTER, but please note that it\u2019s all in German and you\u2019ll need to <a href=\"https:\/\/www.elster.de\/eportal\/registrierung-auswahl\/hinweis2\" target=\"_blank\" rel=\"noreferrer noopener\" aria-label=\" (opens in a new tab)\">create an account<\/a> first. It\u2019ll take a couple of days to get this set up as the tax office will send you activation data by post.<\/p>\n\n\n\n<p>Once you\u2019re officially <strong>registered as a freelancer<\/strong>, you\u2019ll get your <em>Steuernummer or Ust. Nr. (Tax ID) <\/em>and so you will be ready to <strong>start invoicing clients<\/strong>.<\/p>\n\n\n\n<p>The <em>Finanzamt <\/em>will also explain your <strong>tax obligations<\/strong> as a freelancer and let you know when you should <strong>submit your VAT declarations<\/strong>.<\/p>\n\n\n\n<p class=\"has-background\" style=\"background-color:#f3f3f3\">\ud83c\udf0e You can request your VAT ID number (Ust Nummer) as well if you plan to bill VAT in your invoices, for example, if you are going to work with clients in other EU countries (Reverse charge).<\/p>\n\n\n\n<p>If you\u2019re not in one of the countries mentioned above and <strong>would like to become self-employed in Germany<\/strong>, you have options, too.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\" id=\"visa\">#2 Visa<\/h3>\n\n\n\n<p>If you come from a different country, you will be required to <strong>apply for a visa to get employed<\/strong>. Germany offers a <a href=\"https:\/\/www.make-it-in-germany.com\/en\/visa-residence\/types\/self-employment\" target=\"_blank\" rel=\"noreferrer noopener\" aria-label=\" (opens in a new tab)\"><strong>visa for self-employment<\/strong><\/a> that is different if you are planning on setting up a business or working as a freelancer.<\/p>\n\n\n\n<p>If you\u2019re <strong>freelancing in Germany<\/strong>, you\u2019ll need to specifically apply for the <strong>Freelance Visa<\/strong> (according to <a aria-label=\" (opens in a new tab)\" href=\"https:\/\/www.gesetze-im-internet.de\/englisch_aufenthg\/englisch_aufenthg.html#p0624\" target=\"_blank\" rel=\"noreferrer noopener\">Section 21 (5) AufenthG<\/a>). This Visa is typically valid for 3 months and can be converted into a residence permit \u2018Aufenthaltserlaubnis zur freiberuflichen oder selbst\u00e4ndigen T\u00e4tigkeit\u2019 once you\u2019re in the country.&nbsp;<\/p>\n\n\n\n<p>These <strong>residence permits <\/strong>are valid for up to 3 years. If needed, the permit can be extended.<\/p>\n\n\n\n<p>Understanding and obtaining the correct residence permit is essential for a successful and legally compliant stay in Germany. The website <a href=\"https:\/\/www.germany-visa.org\/immigration\/residence-permit\/\" target=\"_blank\" rel=\"noreferrer noopener nofollow\">germany-visa.org<\/a> outlines the different types of German residence permits based on the purpose and duration of your stay in Germany.<\/p>\n\n\n\n<h4 class=\"wp-block-heading\">The requirements for the German self-employed visa are:<\/h4>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Your freelance occupation is recognized as a self-employed professional occupation in accordance to <a href=\"https:\/\/www.gesetze-im-internet.de\/estg\/__18.html\" target=\"_blank\" rel=\"noreferrer noopener\" aria-label=\" (opens in a new tab)\">s. 18 Income Tax Act<\/a>. Freelance occupations include artists, writers, doctors, auditors, architects, or IT professionals such as engineers.<\/li>\n\n\n\n<li>You have enough funds to finance your project (<a href=\"https:\/\/www.berlin.de\/formularverzeichnis\/?formular=\/labo\/zuwanderung\/_assets\/ertragsvorschau.pdf\" target=\"_blank\" rel=\"noreferrer noopener\" aria-label=\" (opens in a new tab)\">Revenue forecast<\/a>)<\/li>\n\n\n\n<li>Having all the paperwork and professional licences required to perform the job<\/li>\n\n\n\n<li>If you are over 45 years old, you\u2019ll need an adequate pension plan<\/li>\n\n\n\n<li>Health insurance covering you in Germany<\/li>\n\n\n\n<li>Your profile has demand in Germany<\/li>\n<\/ul>\n\n\n\n<p>If you meet all the requirements, you can make an appointment at the <strong>German embassy<\/strong> in your country to start your visa application (75 EUR).<\/p>\n\n\n\n<p>With the issuance of your visa for self-employment, you will then book your flight and apply for the <a href=\"https:\/\/service.berlin.de\/dienstleistung\/328332\/en\/\" target=\"_blank\" rel=\"noreferrer noopener\" aria-label=\" (opens in a new tab)\">residence permit for self-employment<\/a> in the city where you live.&nbsp;<\/p>\n\n\n\n<p><a href=\"https:\/\/www.make-it-in-germany.com\/fileadmin\/1_Rebrush_2022\/a_Fachkraefte\/PDF-Dateien\/3_Visum_u_Aufenthalt\/Visagrafik_EN\/220125_Visagrafik_EinBlick_Visa_for_self-employment_EN.pdf\" target=\"_blank\" rel=\"noreferrer noopener\" aria-label=\" (opens in a new tab)\">This graphic from the German government<\/a> shows the process step-by-step.<\/p>\n\n\n\n<p class=\"has-background\" style=\"background-color:#f3f3f3\">\ud83c\udfe0<strong> Address registration (<em>Anmeldung<\/em>): <\/strong>As soon as you find your permanent accommodation, you must register it at your local Resident\u2019s Registration Office <em>\u2018B\u00fcrgeramt\/Einwohnermelderamt\u2019. <\/em>You will then receive your registration certificate (<em>Anmeldebest\u00e4tigung). <\/em>You will need this document to open your bank account or register at the local library, so keep it safe!&nbsp;<\/p>\n\n\n\n<p>Once you have your \u201cAnmeldebest\u00e4tigung\u201d for your address and your freelance visa, you\u2019re ready to register with the tax authorities (<em>Finanzamt<\/em>) as a German would do (See <a href=\"#reg\">process above<\/a>).<\/p>\n\n\n\n<h3 class=\"wp-block-heading\" id=\"health\">#3 Figuring out health insurance<\/h3>\n\n\n\n<p>Germany has two options for health insurance &#8211; <strong>public (statutory) <\/strong>and <strong>private<\/strong>.&nbsp;<\/p>\n\n\n\n<p><strong>Public insurance<\/strong> amounts to <strong>14.6% of your income<\/strong>, plus an additional contribution rate of 1.3% (average).<\/p>\n\n\n\n<p>The minimum contribution payable is around <strong>\u20ac160 (+1.3%) <\/strong>and the maximum is around <strong>\u20ac710 (+1.3%).<\/strong><\/p>\n\n\n\n<p>If you decide to <strong>voluntarily become a part of public health insurance<\/strong>, you will have the option to pick between different public health insurance providers (<em>Krankenkassen<\/em>), too. Among them are AOK, BKK, TK,&nbsp; BARMER, and more.<\/p>\n\n\n\n<p><strong>Private insurance<\/strong> is only available for people who fit a certain criteria, freelancing being one of them.&nbsp;<\/p>\n\n\n\n<p>The rate you pay here is <strong>based on your health profile and risks<\/strong>. Generally, it\u2019s<strong> cheaper for young professionals<\/strong> but could become more expensive as you get older. Also, note that your family won\u2019t be covered here.<\/p>\n\n\n\n<p>It\u2019s advisable to check different alternatives and coverage included before making your decision. There are many <strong>private health insurance companies in Germany<\/strong> you could choose from. Among them are DKV, Axa, Allianz, Ottonova, and more.<\/p>\n\n\n\n<p>If you\u2019re <strong>applying for a Self-employment Visa<\/strong>, you\u2019ll need your <strong>health insurance before you move to Germany<\/strong> or even before you apply for your Visa. This is because your Visa application requires you to have a certain amount of health coverage. This document shows the difference between your income and your expenses and defines your <strong>taxable income<\/strong>.<\/p>\n\n\n\n<p>Your freelance activities will be subject to income tax only if you<strong>r taxable income exceeds \u20ac10,908<\/strong> (Tax free amount \u201cGrundfreibetrag\u201d in 2023).<\/p>\n\n\n\n<p>Freelancers need to pay their <strong>income tax upfront <\/strong>on a quarterly basis to your local tax office \u2018<em>Finanzamt\u2019<\/em>. It\u2019s an estimation and at the end of the year, based on your tax return, the actual amount of tax will be determined.<\/p>\n\n\n\n<p>If you paid too much, the difference will be paid back to you or you might need to make an additional payment if it was less than what it should.<\/p>\n\n\n\n<p>As your profits increase, so will your tax rate for your income. So it\u2019s highly recommended to set extra money aside for taxes in case your profits increase.<\/p>\n\n\n\n<h4 class=\"wp-block-heading\" id=\"vat\">VAT (Mehrwertsteuer, Umsatzsteuer)<\/h4>\n\n\n\n<p>All self-employed individuals in Germany are subjected to pay<strong> VAT or <em>\u2019Umsatzsteuer<\/em><\/strong><em>\u2019 <\/em>.&nbsp;<\/p>\n\n\n\n<p>The<strong> VAT rate that you will apply on your freelance invoice<\/strong> could be either <strong>7% or 19%,<\/strong> depending on the goods and services offered. At the end of the year, you are allowed to file claims on said goods and services.&nbsp;<\/p>\n\n\n\n<p class=\"has-background\" style=\"background-color:#f2f2f2\">\ud83d\udca1 You can easily pay your VAT tax through the official portal of <a aria-label=\" (opens in a new tab)\" href=\"https:\/\/www.elster.de\/eportal\/start\" target=\"_blank\" rel=\"noreferrer noopener\">ELSTER<\/a>.&nbsp;<\/p>\n\n\n\n<h4 class=\"wp-block-heading\">Exception: Kleinunternehmerregelung\u201d (The small business rule)<\/h4>\n\n\n\n<p>Some freelancers will have the option to adopt the \u201c<a href=\"https:\/\/www.existenzgruender.de\/DE\/Gruendung-vorbereiten\/Gruendungswissen\/Steuern\/Kleinunternehmerregelung\/inhalt.html\" target=\"_blank\" rel=\"noreferrer noopener\" aria-label=\" (opens in a new tab)\">Kleinunternehmerregelung<\/a>\u201d to not add VAT (Ust) on their invoices if they are not earning more than \u20ac22.000 this year, and no more than \u20ac55.000 the next one.<\/p>\n\n\n\n<h4 class=\"wp-block-heading\" id=\"trade\">Trade tax (Gewerbesteuer)<\/h4>\n\n\n\n<p>The <strong>trade tax or <em>\u2018Gewerbesteuer\u2018 <\/em><\/strong>varies depending on what city you\u2019re in. Sole proprietorships and corporations are all subjected to this tax.&nbsp;<\/p>\n\n\n\n<p><strong>Trade tax<\/strong> only applies to <strong>self-employed traders and NOT to freelancers<\/strong>. It is also paid to the \u2018<em>Finanzamt\u2019 <\/em>as part of the tax declaration.
