Adopted in 2024, the regulation will be phased in starting in 2025. This category includes AI in critical infrastructure, law enforcement, or HR processes. Even participation in projects involving these applications can place freelancers under high-risk obligations.<br><\/li>\n\n\n\n<li><strong>Limited risk<\/strong>: AI that interacts with users, like chatbots or content-generating tools, must meet transparency and labeling obligations.<br><\/li>\n\n\n\n<li><strong>Minimal risk<\/strong>: Systems such as spam filters or video games are lightly regulated or exempt.<\/li>\n<\/ul>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Who_is_affected_by_the_AI_Act\"><\/span>Who is affected by the AI Act?<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>The AI Act <strong>applies to developers, providers, and users of AI systems<\/strong> \u2013 regardless of company size. Whether a system is subject to stricter requirements depends on its area of application and the associated risk. <strong>Freelancers and small agencies are affected<\/strong> if they:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Develop or train AI applications<\/li>\n\n\n\n<li>Offer AI-based services like chatbots or content generated using ChatGPT <\/li>\n\n\n\n<li>Use tools like GPT-4 or Midjourney to create content <\/li>\n<\/ul>\n\n\n\n<p>The law distinguishes between internal use and commercial offerings. If you offer AI-based products or services to clients, stricter rules apply.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Key_requirements_for_freelancers_under_the_AI_Act\"><\/span>Key requirements for freelancers under the AI Act<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>Freelancers who develop AI systems or offer them as service providers will soon have to meet certain legal requirements. These <strong>obligations depend on the risk category<\/strong> assigned to the specific project. The regulations are particularly relevant for applications with limited or high risk. However, even for lower-risk systems, minimum standards still apply.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">1. Transparency obligation<\/h3>\n\n\n\n<p>If a tool or service uses AI, <strong>users must be clearly informed<\/strong>. This applies particularly to chatbots and generative AI tools. The user must know that they are interacting with an AI system and not with a real person.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">2. Labeling obligation<\/h3>\n\n\n\n<p>AI-generated content <strong>must be labeled<\/strong> as such, depending on the context. For example, if a text, image, or video is created using Artificial Intelligence, it may be necessary \u2013 depending on the context \u2013 to label the content as AI-generated. The goal is to prevent deception and help users <strong>properly interpret the nature of the content<\/strong>. <\/p>\n\n\n\n<h3 class=\"wp-block-heading\">3. Documentation requirement<\/h3>\n\n\n\n<p>Freelancers developing AI applications must <strong>document their systems<\/strong> in a technically comprehensible way. Required information includes model training, data sources, algorithms, and intended use. This is especially important for high-risk applications and must be made available to regulatory authorities upon request.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">4. Duty of data diligence<\/h3>\n\n\n\n<p>Another important aspect is the requirement for data quality. AI systems cannot be trained with arbitrary datasets. The AI Act mandates that <strong>training data must be representative, as error-free as possible, and free from discrimination<\/strong>. Freelancers involved in development must ensure their datasets meet these criteria.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">5. Conformity marking<\/h3>\n\n\n\n<p>In some cases, the AI technology used must also be registered or provided with what is known as a <strong>conformity marking<\/strong>. This primarily <strong>affects applications embedded in products<\/strong> \u2013 such as hardware solutions that require <strong>CE marking<\/strong> under the AI Act. A transition period has been in place since then, during which the new rules are being gradually phased in.<\/p>\n\n\n\n<p>Since February 2025, certain AI systems classified as posing an <strong>unacceptable risk<\/strong> have been banned. Starting in <strong>August 2025<\/strong>, additional requirements will apply \u2013 for example, for providers of <strong>general-purpose AI models<\/strong> and for the implementation of <strong>supervisory structures<\/strong>.<\/p>\n\n\n\n<p>By <strong>August 2026<\/strong>, all provisions of the AI Act will be fully applicable. For <strong>AI systems integrated into physical products<\/strong>, special transitional arrangements apply, extending the deadline until <strong>August 2027<\/strong>.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Opportunities_through_the_AI_Act\"><\/span>Opportunities through the AI Act<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>The AI Act brings not only new obligations but also <strong>new chances for freelancers<\/strong>. <\/p>\n\n\n\n<p>A significant opportunity lies in the growing <strong>demand for consulting on AI compliance<\/strong>. Small and medium-sized enterprises in particular need <strong>external support to implement AI projects in accordance with the law<\/strong>. Freelancers with the right expertise can play a key role here, and they can position themselves, for example, as:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong><a href=\"https:\/\/www.freelancermap.com\/blog\/what-does-ai-specialist-do\/\">AI compliance consultants<\/a><\/strong> for SMEs<\/li>\n\n\n\n<li>Specialists in<strong> <a href=\"https:\/\/www.freelancermap.com\/blog\/what-does-ai-ethics-officer-do\/\">ethical AI development<\/a><\/strong><\/li>\n\n\n\n<li><strong><a href=\"https:\/\/www.freelancermap.com\/blog\/what-does-project-manager-do\/\">Project managers<\/a><\/strong> overseeing compliant AI implementation<\/li>\n<\/ul>\n\n\n\n<p>Standardized rules will also help professionalize the AI market. Freelancers who stay informed and prepare early will have a clear competitive advantage.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Challenges_freelancers_may_face\"><\/span>Challenges freelancers may face<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>At the same time, the new legal regulation brings challenges, such as:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong>Legal complexity<\/strong>: Categorizing AI technologies into risk levels is not always clear-cut and can lead to uncertainty, especially in projects involving hybrid applications. <br><\/li>\n\n\n\n<li><strong>Industry-specific rules<\/strong>: In addition, there are industry-specific regulations \u2013 such as in healthcare or HR \u2013 that may impose additional requirements and must also be taken into account. <br><\/li>\n\n\n\n<li><strong>Client hesitation<\/strong>: Clients may become more hesitant to initiate AI projects in the future, particularly if they are unsure about the legal requirements. If complying with the AI Act seems too demanding, companies may postpone such projects. This highlights once again that freelancers&#8217; qualifications and specialization can be a decisive factor in project acquisition.<\/li>\n<\/ul>\n\n\n\n<p>In the long run, the AI Act could help <strong>strengthen trust in AI systems<\/strong>. As a result, there may be increasing demand for compliant AI development \u2013 opening new doors for freelancers with the right expertise.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"How_freelancers_can_prepare\"><\/span>How freelancers can prepare<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>According to the <a href=\"https:\/\/www.freelancermap.com\/market-study\">Freelancer Study 2025<\/a>, <strong>77% of freelancers already use AI tools<\/strong>.
