Description

Claims and Litigation Consultant

Claims and Litigation Consultant required to handle Claims management to receive all clinical negligence claims and liaise with NHS Litigation Authority, panel solicitors and clinical staff to ensure these are managed effectively, in accordance with national guidance and trust policy.

Ensure a claims database is established and maintained in order to meet reporting requirements of the NHSLA together with production of management reports.

Obtain witness statements from clinical staff, in liaison with panel solicitors.

Ensure the preservation of appropriate documentation and any other evidence required during the investigation and defence of claims.

Identify lessons learned from individual claims so that action needed to prevent future harm can be taken.

Facilitate a quarterly update meeting with clinical directors on new claims, closed claims, claims progress and trends.

Coroner and Inquest Liaison

Act as corporate lead for inquests, ensuring the organisation has a consistent approach to Inquest management which is supportive to both staff and patients' families.

Ensure the executive team and relevant line managers are aware of all inquests and their progress.

Ensure appropriate sharing of information between clinical and corporate services in relation to planning for complex or high profile Inquests.

Provide support and guidance to staff involved in Inquests, keeping the executive team briefed of developments.

When external legal representation is indicated, with approval, instruct trust solicitors throughout the process.

Information management

Responsible for managing complex, sensitive and contentious information adhering to information governance principles.

Maintaining up to date and accurate information about each complaint, concern and clinical negligence claim in the Datix database.

Responsible for the production and accuracy of monthly quality and performance reports for Board and sub-committees. Undertake formal presentations as required.

Leading on the submission of Complaints information to the Department of Health.

Responsible for the production of information leaflets on how to complain, maintaining version control and content.
