Description

ESTATES VALUATION SURVEYOR required to work for a telecommunications company based in Berkshire.

Background to the Estates Valuation Surveyor:

  • The Digital Economy Act 2017 incorporated a significantly revised Electronic Communications Code (ECC). The revised ECC will, following a Commencement Order bringing it into effect, result in substantial changes to business practices and processes.
  • The reformed Electronic Communications Code presents Operators significant opportunity to responsibly reduce the cost and time to implement network and upgrade rollout.
  • The ECC introduces revised valuation principles and the concept of a "No Scheme" valuation basis incorporating both consideration and compensation elements.
  • Whilst the reformed ECC will not have retrospective effect upon in term agreements entered into under prior ECC regime, how Operators approach upgrading and sharing of their sites will change significantly following the introduction of the new Code.

The Estates Valuation Surveyor will be responsible for ensuring that site Agreements are renewed optimally.

We are innovating and optimising business processes to reflect the changes in the ECC. The Estates Valuation Surveyor will be responsible both to contributing toward this process of reform and for the subsequent implementation of it.

Initially the Estates Valuation Surveyor will be part of a small team running workshops and training to Managed Service Providers, Small Works Contractors and other suppliers.

Subsequently the role will focus upon the effective implementation of revised Lease and Agreement Renewal Processes, their ongoing evolution and optimisation and also compliance auditing.

The Estates Valuation Surveyor holder will be responsible for the overall ISO (Isolated Owner) and MSP (Multi-Site Provider) Renewal Strategy under ECC.

The ECC provides for revised Valuation principles to be adopted as well as introducing other key changes which will impact the agreements which are entered into.

This Estates Valuation Surveyor will be the recognised ECC Agreement Renewal Specialist within the Property Team. Ensuring that wherever possible consensual agreement is sought with existing Site Providers but reflecting the revised basis of valuation and wider rights afforded through the legislation and the operational needs of the occupier(s).

It is recognised that in certain instances, consensual agreement will not be capable of being reached. The ECC provides for a framework for making application to Court, for the Courts to determine whether rights are to be conferred upon the operator and the terms of such rights of occupation. The role holder will be responsible for reviewing and making internal recommendations concerning when to make such Court referrals.

It is also recognised that Landowners may instigate the referral process to Court for determinations. The Role holder will be responsible for the tracking of all such referrals and for ensuring that the Property considerations are fully accounted for when making appropriate decisions and for ensuring that all other appropriate considerations are taken into account.

The successful Estates Valuation Surveyor will have:

  • Property knowledge
  • Property related Qualifications eg RICS or CAAV membership or comparable experience.
  • Ideally Knowledge of Code (Digital Economy Act)
  • Demonstrable experience in Business Process and Transformational Change.
  • Have worked in an Operator, Managed Service Supplier or Small Works Contractor environment and or for a Utility Company.
